These Terms of Service (“Terms”) govern your use of the Burgee plugin and the website getburgee.com, provided by Vortex Networking, LLC (“we,” “us,” or “our”).
By downloading, installing, or purchasing Burgee, you agree to these Terms. If you do not agree, do not use the plugin.
1. The software & license
Burgee is a WordPress plugin offered in two editions:
- Free edition — distributed under the GNU General Public License v2 or later (GPL), consistent with WordPress. You may use it under the terms of the GPL.
- Pro edition — sold as an annual subscription. One Pro license covers one website (one WordPress installation). A valid, active license entitles that website to the Pro features, automatic updates, and support for the license term. The plugin's code remains licensed under the GPL; the subscription is for the license key, updates, and support.
You agree not to share, resell, or use a single-site license on more sites than it covers. Running the plugin on additional websites requires additional licenses.
2. Fees, billing & taxes
Pro is offered at $149 per year, per website (prices may change for future terms; the price shown at checkout applies to your purchase). Purchases are processed by our reseller, Freemius, Inc., which acts as the Merchant of Record. Freemius handles payment, invoicing, and applicable sales taxes/VAT, and your purchase is also subject to Freemius's terms.
3. Automatic renewal & cancellation
Pro subscriptions renew automatically at the end of each term so your license, updates, and support continue without interruption. You may cancel at any time through your Freemius account or by contacting us; cancellation stops future renewals. When a subscription ends, the Pro features pause, but — importantly — none of your data is deleted, and Pro features reactivate instantly if you license the site again.
4. Refunds
Refunds are governed by our Refund Policy, which forms part of these Terms.
5. Acceptable use
You agree not to use Burgee to break the law, infringe others' rights, or attempt to disrupt or gain unauthorized access to our systems or those of Freemius. You are responsible for your WordPress site, its security, and the data you enter into the plugin.
6. Intellectual property
“Burgee,” the Burgee logo, and the getburgee.com website content are the property of Vortex Networking, LLC, except for the plugin's source code to the extent it is licensed under the GPL. Nothing in these Terms transfers our trademarks or branding to you.
7. Support & updates
An active Pro license includes access to updates and priority support for the licensed website during the subscription term. Documentation and community resources are available to all users. We aim to respond to support requests promptly but do not guarantee a specific response time.
8. Disclaimer of warranties
Burgee is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the plugin will be error-free or uninterrupted, or that scoring output will meet every requirement of your specific event. You are responsible for verifying results before publishing or relying on them.
9. Limitation of liability
To the fullest extent permitted by law, Vortex Networking, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of Burgee. Our total liability for any claim relating to the plugin will not exceed the amount you paid us (or via Freemius) for the plugin in the twelve months before the claim.
10. Termination
You may stop using the plugin at any time. We may suspend or terminate a license for violation of these Terms. On termination, the license grant for Pro features ends; your data within your own WordPress installation remains yours.
11. Governing law
These Terms are governed by the laws of the State of Michigan, United States, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Michigan, and you consent to their jurisdiction.
12. Changes & contact
